These conditions are agreed between Sporting Clube de Portugal – Futebol SAD, with headquarters in Estádio José Alvalade in Rua Professor Fernando da Fonseca, Apartado 4120, 1501-806 Lisbon, tax nº 503 994 499, and any other person – User – who wishes to make a purchase online through this website.
1.1 The official online store at www.lojaverde.sporting.pt is managed by Sporting Clube de Portugal – Futebol SAD.
1.2 All content and webpages available on the website and all content related to these elements are licenced or are operated under the authorisation of Sporting Clube de Portugal – Futebol SAD.
1.3 The Club reserves the right to modify freely and at any time the present Terms and Conditions in order to make them more adequate in relation to the applicable legislation with no prior notice necessary. These modifications will serve to improve the website, while simultaneously improving the services offered to the User. Any such modifications will become applicable immediately after their publication on the website.
1.4 The User recognises that all content is protected by the author’s rights belonging to Sporting Clube de Portugal and the applicable legislation. Sporting Clube Portugal will not tolerate any infringement of these intellectual, industrial, personality or property rights.
2. USER REGISTER
2.1 Sporting Clube de Portugal recommends that the User registers on the sub-domain www.lojaverde.sporting.pt in order that the best service, adequate to the preferences of each User, can be provided. This registration is associated with the domain www.sporting.pt and therefore the Users who are already registered on this domain are only required to log in to the Online Store.
2.2 To complete an order, we recommend previous registration on the website, thereby introducing your full name, email, password and other additional information, in conformity with the indications given during the registration process.
2.3 In the case that the User is a Member of Sporting Clube Portugal, the User should provide their Membership details on the domain www.sporting.pt to benefit from a 10% Member discount.
2.4 By using Loja Verde Online Store and in benefiting from our services, the User verifies that all information provided is true, accurate, current and complete, with the User guaranteeing that this information will be updated as necessary. Should any of the information provided be incorrect, any contractual obligations for Sporting Clube de Portugal will be immediately suspended.
2.5 Should the User be under the age of 18, the User should seek the autorisation of a parent or guardian before:
- Contacting the Online Store via email
- Sending any information to the Online Store
- Purchasing any products from the Online Store
In continuing to use this website and any services provided, the User confirms that he/she has obtained the consent of a parent or custody. The Club recommends the sharing of these Terms and Conditions with the respective parent or custody before completing registration process.
3. EMAIL SERVICE
All emails related to the Loja Verde Online Store are subject to the present Terms and Conditions.
4. CONTRACTUAL AGREEMENT
Contracts ae agreed through the website www.lojaverde.sporting.pt electronically and are available in Portuguese and English.
5. USE OF CONTENT
5.1 All content included in www.lojaverde.sporting.pt (logos, images, videos and and text) is the property of Sporting Clube de Portugal.
5.2 Any modification, copying, distribution, transmission, publication, licencing or creation of contents or products based on the content of Sporting Clube de Portugal without prior authorisation is strictly prohibited.
5.3 Sporting Clube de Portugal may at any time and at its convenience suspend or discontinue any content made available on the website, with no prior notice required and without any requirement to compensate third parties for such alterations.
5.4 When navigating or using the website, the User is obliged to comply with the applicable legislation, thereby refraining from using this platform or its content for activities which are contrary to the law, morals, customs, rights or interests of other third parties.
6. PRODUCT AND PRICE INFORMATION
6.1.1 The guarantee period for products begins from the moment in which the product(s) is/are sent by Sporting Clube de Portugal to the address indicated by the User.
6.2.2 Sporting Clube de Portugal reserves the right to change at any time the information about the commercial offer announced on prices, promotions and commercial conditions.
6.2.3 In the event of the presentation and consequent sale of a product at an incorrect price or outside the scope of certain clearly announced commercial conditions, such situations arising from technical anomalies will be identified in the order processing. The Customer will be informed of such situation by email, giving Sporting Clube de Portugal the option of the customer accepting the order at the correct value, or proceeding with the respective cancellation with a refund of the amount already paid, within 15 days from the date of communication of the situation. If after 30 days there is no customer feedback, the process will be terminated, and there will be no later rectification of the order. These rectifications include exchanges and returns.
6.2.4 Sporting Clube de Portugal is under no obligation to supply any order or product whose price is incorrect, if the error is notorious, unequivocal and should have been identified by the Customer in reasonable circumstances, even if Confirmation of Payment or Shipment has already been sent.
6.1.5 Questions related with the guarantee(s) of licenced products are dealt directly with the producer of the respective brand product and are not the responsibility of Sporting Clube de Portugal.
6.1.6 Product customization is possible only in the products identified for this purpose.
6.1.7 The customization of products can be made with the use of letters, number and/or badges, with these elements items identified along with the respective products and with character limits applicable in conformity with the particular product.
6.1.8 The completion of orders from the Loja Verde Online Store is subject to stock availability. Should stock be temporarily unavailable or should a customer have ordered a product which is out of stock, Sporting Clube de Portugal will inform the User by email, providing as an alternative i) other products which correspond to the ordered product, ii) indicate the approximate date of replacement of the ordered product. In the latter case, the User may opt to cancel the order and be refunded through the same payment method used to order.
6.2.1 The price of products available online is always in euros (€), including the applicable Value Added Tax (VAT), except in the case of obvious error.
6.2.2 Prices are subject to alteration at any moment, with alterations not affecting orders which have already had shipping confirmed.
6.2.3 The prices used on this website are independent to the prices used in physical stores, without prejudice to any eventual coincidences.
6.2.4 When the User has completed an online purchase, all products chosen will appear in the shopping cart. At the end of the process of selecting/choosing products, the User should confirm what has been selected, the total cost of the purchase and the shipping and billing information and make the payment.
6.2.5 The price paid for each product may be subject to shipping costs, which will be added to the final price of the order.
6.3 MEMBER DISCOUNT
6.3.1 Should the User also be a Member of Sporting Clube Portugal, the User should provide such details in the Profile section of the domain www.sporting.pt to benefit from a 10% Member discount. The registration information of the User is shared with the domain www.sporting.pt and Users who are already registered on the domain are only required to log in to the Loja Verde Online Store.
6.3.2 Member discounts are only applied in the case that the User has made all Membership fees due at the time of ordering online. For members with 1 month or more of fees in arrears, the discount will not be valid.
6.3.3 Member discounts are not applicable to products already in promotion.
6.3.4 If the member discount is not applied after confirmation of the points above, the User should contact email@example.com before paying the order.
6.3.5 If the User pays the order without validating the member discount, this amount will not be refunded.
7. CAMPAIGNS AND PROMOTIONS
7.1 Campaigns and promotions on the Loja Verde Online Store are not automatically applicable in Sporting Clube Portugal’s physical store(s) and can be exclusive to either. These cases will be properly identified/indicated as necessary.
7.2 PROMOTIONAL CODES
7.2.1 When used under the established regulations, a promotional code allows the User to benefit from a promotion in relation to the purchase of a specific product or a collection of products during the period of time indicated/associated with the respective promotional code/campaign.
7.2.2 Promotional codes are only valid for purchases made online, on www.lojaverde.sporting.pt.
7.2.3 The use of promotional codes for commercial or professional purposes is not allowed.
7.2.4 Promotional codes will automatically be applied on the request of the User and will be reflected on the total price of the final bill. Such codes cannot be redeemed for their monetary value.
7.2.5 Promotional codes can only be used once per order and are not cumulative with other discounts.
7.2.6 Some codes may be intended to use exclusively on specifically determined purchases or products.
8. PAYMENT METHODS
To complete an order, the User has the following forms of payment:
- ATM REFERENCE
Sporting Clube de Portugal reserves the right to only accept the payment methods detailed above.
All orders are valid for 72h.
Following this period, orders which have not been paid for will be cancelled and an email communicating such cancellation will be sent to the User.
9. SECURE PAYMENT
9.1 In order to minimize the probability of non-authorised access to the User’s bank details, the data from the credit card used will be encrypted and sent to the service supplier, ensuring that third parties cannot access the transmitted information.
9.2 Payment with credit cards is subject to the verification and authorisation of the issuing entity. Should the issuer of the respective bank card not authorize payment, Sporting Clube de Portugal cannot be held responsible for any delay or failure of delivery and can refuse any such contractual agreement with the User.
9.3 Under no circumstance can Sporting Clube de Portugal be held responsible for any damages suffered as a result of electronic communication methods, including but not limited to damages resulting from the failure of electronic communications, interception or manipulation of communications or the transmission of viruses.
9.4 The information used for payment is confidential and will not be used by Sporting Clube de Portugal, except in relation to billing and/or refunds.
10. ORDER SHIPPING
10.1 The delivery of orders is subject to the User’s payment of shipping costs which are applicable at the time or order.
10.2 Shipping cost include Value Added Tax at the applicable rate.
10.3 In the case of shipping to countries which are not part of the European Union, these order will be subject to the payment of the Customs Fees which are determined by the destination country and are the sole responsibility of the User. In the case of the return of orders to Sporting Clube de Portugal due to a failure to pay Custom Fees, the payment of shipping for resending to Portugal will not be the responsibility of the User.
10.4 The order will be delivered by a transportation company to the address indicated by the Use when making the order. Such services will be provided in a way adequate for each particular situation.
10.5 The User will be informed by SMS and / or email of the location of his order. If it is not delivered (for reasons such as Absent Recipient or Incomplete / Incorrect Address), the User will be notified by the shipping company in order to proceed with a reschedule and / or change of delivery address.
10.6 If there is no rescheduling requested by the User, and in the event of the carrier's failure to deliver the order to the recipient, it will be returned to the Sporting Clube de Portugal warehouse.
10.7 The User must contact Sporting Clube de Portugal again to reschedule a new delivery, the costs of which will be borne by the User. You can contact firstname.lastname@example.org by communicating the address to which you want the order to be re-dispatched, prior to the settlement of the associated shipping costs.
10.8 Should the User not claim undelivered orders within 30 days, Sporting Clube de Portugal reserves the right to give another destination due to the products.
10.9 Sporting Clube de Portugal will make all necessary efforts fulfil delivery of orders within the period stipulated, should the ordered product(s) be available.
10.10 Sporting Clube de Portugal is not responsible for any delays to delivery which cannot be attributed to a process controlled by the Club. Any such delays are the responsibility of the shipping company.
10.11 The shipping of orders will only occur on work days, meaning that weekends and holidays are excluded from estimated delivery times.
10.12 Any errors made by the User when ordering or alterations to orders can only be rectified/made up to the point in which the respective order is finalised by the User, which occurs on making payment.
10.13 Shipping is free on orders equal to or over 100€ in the case of addresses in Portugal, excluding Açores and Madeira. Costs are calculated by the shipping company in all other cases and are dependent on required delivery time, weight and destination.
11. RIGHT TO TERMINATION
APPLICABLE TO PURCHASES MADE ON WWW.LOJAVERDE.SPORTING.PT
The User has the right to freely terminate the contract, with the right to refund of payments made under the terms of the legislation cited below, namely Decree Law nº 24/2014 of the 14th of February, without no indication of reason or payment of compensation required.
11.1 Except in expressly indicated cases, the User can freely terminate the contract without making any form of compensatory payment or indicating the respective reason, thereby proceeding with exchange or return within a period of 30 (thirty) days following the delivery of the ordered products at the destination address.
11.2. The right to termination provided for in the previous point can be made through an email sent to Sporting Clube de Portugal through email@example.com, within the period indicated in the previous point and using the form which can be downloaded by clicking on FORM. The form must be correctly filled in and signed, with the desire to terminate the contract clearly stated. After receiving the form, Sporting Clube de Portugal will sent the User an acknowledgement of reception of the request (for example by email) within a period of 24 (twenty four) hours.
11.3 The communication of the desire to exercise the right to the free termination of the contract within the stipulated period is all that is required for such a request to be valid.
11.4. The right to termination is only valid should the customer return the product(s) within 14 days from the date on which the exercise of this right has been communicated to Sporting Clube de Portugal, in conformity of the previous point and with the product(s) being returned in the exact conditions in which it/they were shipped to the address indicated by the User and with the delivery of a copy of proof of purchase.
11.5. The costs of sending returned products to the Sporting Clube de Portugal warehouse will not be charged under the following conditions:
i) When return is made by the User due to a defect in the production of a product, in which case it is the responsibility of Sporting Clube de Portugal to collect and cover the costs of delivery.
ii) When return is made by the User due to dissatisfaction with the purchase and when an exchange for any other item is not applicable. In such cases it is the responsibility of the User to made delivery of the products ordered to the address indicated in point 11.6. and in agreement with the indications of point 11.4, within the period stipulated for this purpose and with the User responsible for any costs inherent to delivery to our wharehouse.
11.6. In the case of ii) of point 11.5, the delivery of products to be returned should be made to Estádio José Alvalade, Armazém Loja Verde - Multidesportivo Piso 1 , Rua Prof. Fernando da Fonseca 1600-616 Lisboa.
11.7. Sporting Clube de Portugal may withhold refund until the product(s) has/have been received or until the User provides proof of postage of the product/product(s).
11.8. The customer does not have the right to free termination of the contract on the following:
(i) customized products (considered as being products on/in which any characteristics specifically requested by the customer have been applied, such as letters, numbers and badges)
(ii) contacts for goods or services which have been acquired and which, due to their nature, cannot be reconstituted
(iii) the provision of digital context which has not been provided in digital format
(iv) the provision of services which have already been provided after request form the customer during a period prior to the 14-day deadline for the free termination of the contract.
11.9. In case of termination of the present contract and following the confirmation of the condition of the returns products, the User will be refunded for the costs pf the products, never including delivery costs ( and excluding any supplementary delivery costs resulting from the return), without any unjustifiable delay and within a maximum period of 14 days after the communication of the User’s wish to terminate the contract.
11.10. In the case of the exercise of the right to terminate the contract by the User under the terms indicated above, Sporting Clube de Portugal will make a refund of the amounts paid by the User of the delivered products - never costs inherent to delivery – via a digital gift voucher. Should the User require another form of refund, this should be communicated to firstname.lastname@example.org.
11.11. The right to terminate the contract will only be effective if products are in the same condition in which the User received them. Returned products must contain all items which they are composed of (accessories, manuals, tags, packaging…). Any damaged items which were not in such a state when delivered or which have signs of incorrect use beyond the opening of packaging will not be accepted. The User must guarantee all the necessary care with the products being returned while in possession of these products. Sporting Clube de Portugal reserves the right to refuse the return of an article which does not have the respective tag or which has been altered from the original condition, thereby implying that no refund will be made in such cases.
11.12. In the case that the User accepts an exchange, products must comply with the conditions outlined in point 11.11. The payment of delivery costs of the new product will be provided for as follows:
i) When exchange results form a defect of a product sold by Sporting Clube de Portugal, the Club will cover the costs of sending the new product (return of the product to be exchanged and the sending of the new product)
ii) When the exchange is made on request of the User and in cases in which no product defect is detected, or through error in choosing products which is not attributable to Sporting Clube de Portugal, the costs will be shared. The costs of return of the products for exchange will be the responsibility of the User and the cost of sending the new product will be covered by the Club.
12. USER OBLIGATIONS
As a condition for use under these Conditions, the User is obliged:
a) To respect the rights of Sporting Clube Portugal and other relevant third parties.
b) Not to act against proper standards and to respect any legal obligations, thereby making proper use of the website under the present Conditions which have been read, understood and accepted without any reservation;
c) Not to modify any software in any way or not to use any modified software, namely those with the objective of obtaining access to any reserved content or elements which are not authorised by the present Conditions.
